Effective January 1st, 2021, Employees are able to decide if their call out time is for kin care.
Prior to January 1st, 2021, employers were forcing employees to use (and exhaust) their kin care time first.
This caused employees to not have kin care time when they actually needed it for kin care.
Example: Let’s say an employee wanted to utilize FMLA time for a chronic condition that was covered by FMLA. They were not given that option. Rather, the Company unilaterally took from their allotment of kin care first. Now, Employees are the ones to make the determination how their time will be coded.
